1. Agreement and eligibility
By purchasing the Restaurant Merch Launch Kit, you agree to these Terms of Service and the Refund Policy. You confirm that you are at least 18 years old and are authorized to purchase services and approve artwork on behalf of the restaurant or brand named in the order.
2. What the $500 package includes
The fixed-price package includes two custom merchandise designs, six product mockups, setup of up to ten merchandise products, a branded online store setup, print-on-demand fulfillment setup, pricing and profit-margin guidance, one promotional launch graphic, and two rounds of design revisions.
Unless agreed in writing, the package does not include logo creation or rebranding, photography, copywriting, paid advertising, ongoing store management, custom manufacturing, inventory, samples, product or shipping costs, platform fees, payment-processing fees, taxes, or work beyond the listed scope.
3. Payment
The full $500 service fee is due at checkout. Payment reserves creative production time and authorizes Graphic Wardrobe to begin after the required onboarding materials are received. Payments are processed by third-party payment providers; Graphic Wardrobe does not receive or store your full payment-card number.
4. Client materials and responsibilities
You agree to provide complete, accurate brand materials and timely feedback, including usable logo files, brand references, merchandise preferences, and any required names or wording. You represent that you own or have permission to use everything you provide. You are responsible for reviewing spelling, artwork, product details, prices, and store information before approval and launch.
5. Timeline and revisions
The standard seven-business-day production timeline begins only after full payment and receipt of all requested onboarding materials. It is a good-faith project target, not a guaranteed launch date. Incomplete materials, delayed feedback, scope changes, platform outages, or third-party delays may extend the schedule.
Two revision rounds are included. A revision round means one consolidated set of reasonable edits to the selected direction. New concepts, piecemeal feedback, additional products, or work outside the approved scope may require a new quote and schedule.
6. Approvals and launch
Your written or electronic approval authorizes Graphic Wardrobe to finalize the approved work and configure it for launch. Changes requested after approval may be billed separately. Product availability, production quality, shipping, returns, and platform uptime are subject to the policies and performance of the selected print-on-demand and ecommerce providers.
7. Intellectual property
After full payment, Graphic Wardrobe grants the client a non-exclusive, perpetual license to use the final approved artwork for the client’s restaurant merchandise and related promotion. Unselected concepts, drafts, source files, working files, methods, templates, and pre-existing Graphic Wardrobe materials remain Graphic Wardrobe property unless a separate written assignment says otherwise. Third-party fonts, mockups, stock assets, platforms, and product templates remain subject to their own licenses.
8. Portfolio use
Unless you request confidentiality in writing before launch, Graphic Wardrobe may display the final public-facing work in its portfolio, website, social channels, and promotional materials. Confidential business information will not be intentionally disclosed.
9. Cancellations and refunds
Cancellations and refunds are governed by the separate Refund Policy, which is incorporated into these terms. In short: a full refund is available if you cancel before creative work begins; once creative work begins, the service fee is non-refundable except where required by law or where Graphic Wardrobe cannot provide the agreed service.
10. No sales guarantee
Graphic Wardrobe provides creative and setup services. We do not guarantee merchandise sales, revenue, profit, advertising results, customer demand, or uninterrupted third-party platform performance.
11. Limitation of liability
To the fullest extent permitted by law, Graphic Wardrobe will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from the service or third-party platforms. Graphic Wardrobe’s total liability for any claim related to the package will not exceed the amount you paid for the service. Nothing in these terms excludes liability that cannot legally be limited.
12. Governing law and changes
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. If any provision is unenforceable, the remaining provisions continue in effect. The terms in effect when you purchase apply to that project; material changes will not be applied retroactively without your agreement.
